i saw this on another board...pay attention to exactly what you're reading. looks like anther bullshit lawsuit to me. i am in no way associated or representing bsn but there is one thing constant in this lawsuit happy society that we live in...if you're on top, people are going to come at you from all angles to get in on the action.
i called bsn and they are fully aware of the situation and they are going to send me their coutersuit info.
i wouldn't go screaming guilty as ACCUSED just yet.
i use their products and personally like them. i guess what i'm trying to say is before you go and throw all your bsn products in the trash and declare them useless, wait and see where this goes. i will post info from bsn as soon as they release it to me.

Sounds like you work in or around the industry? Very true what you said about passing judgement before all facts are out, I guess I cannot fathom what in the world anyone would gain by a bogus suit like this? I agree that when you are the top of your industry you do become a target. Are there several supplement companies in recent years that have had lawsuits alledging certain products in their line as aboslutely worthless?
It certainly sounds like something that someone could contrive for personal gain, but what would it be? Maybe I don't think like a golddigger I guess. Rest assured, even if something is labeled as worthless - if I spent my money on it, I would use it. I will edit the my prior post, 'till all the facts are known.

this is bsn's first legal response to this lawsuit...first of many i'm sure, i also found out a couple other interesting facts that cannot be revealed since all of this is under closed files for now. as i said earlier, i do not represent bsn in any way. my only interest here is to keep you guys informed. i do think they have great products, therefore i use them and from the info i have gatherered i will continue to do so, and in a couple weeks, i think you guys will feel the same!!

The Lawsuit alleges that: 1) CEM3 does not exist in CELLMASS®, N.O.-XPLODE™ or NITRIX®; 2) BSN’s patent pending for CEM3 does not exist; 3) CEM3 does not exist; and 4) BSN is the alter ego of Chris Ferguson.
BSN contends that all of the claims made against it and Chris Ferguson are meritless and intends to vigorously defend itself against these allegations. The Lawsuit is based upon a single test which did not directly test for the presence of the CEM3 ingredient, by a laboratory that never contacted BSN for information about CEM3. Contrary to the speculation of Call Jensen’s lawyers, a patent application for CEM3 does indeed exist and is currently pending before the United States Patent and Trademark Office. BSN is not the alter ego of Mr. Ferguson or any of its officers, but is a Delaware corporation in good standing and which observes all required corporate formalities.
